Then think again!
I just got off the phone with a corporate client with a home base of Ohio. How did she find us? Yes indeed Gertrude, on the net!
I have an event tomorrow in Pasco county for an engineering firm based in Atlanta. The brass are flying in tomorrow to throw a thank-you party for the sister company. It's our third year there, so we must be doing something right!
One of the things that impressed her most (being out of town) was that she could see exactly what we do/offer, see some price information, and trust us to do her event by taking a look at our client list.
I have catered events for travel agents in Minnesota, church groups from L.A., brides from Chicago, family reunions from all over the country, and the list goes on.........................
Summertime here is slooooow for our business. I booked a family reunion/birthday party today for August 2nd- YeeHaw!!! They found me on the net as well.
Without a web site, there is no doubt what the impact in my bottom line would be.

I ask all my customers where they got my name and I would say that 80-90% say the internet. The rest is word of mouth and a few flyers. I couldn't operate without the web page. _________________ 18.5" WSM & 22.5" WSM

I get about 300 NEW hits a day on my web site. Even though I do not sell anything there, they do come and have some fun.

Argh!
But how many New hits would you get a day if you did sell something, or they had other ways to have fun, like a forum or a guest book or a recipe section or a photo gallery, or the pages laid out with some consistency?
Not trying to take a pop Ed, just some of the things I've mentioned to you before.
The redeeming thing about your site Ed, is that the information is IMO absolutely First Rate, you know your stuff and your pits and you've had lots of fun experimenting with your cooking techniques, you've always been willing to try it all another way and see what does actually work.
If nothing else this saves the rest of us a shoot load of, time, effort and money that we'd otherwise have to spend to recreate the great information you already supply.
So I understand your reluctance to spend, time, effort or money on a website that is just a repository of the fun information you've gathered, and a place that others can come and learn a short cut or interesting technique, that isn't going to earn you a million bucks or cost you a million bucks. _________________ Here's a change Robert.

Here's a problem I am having. Some of you from Tennessee might recognize this: TN has a chain restaurant called Tops "Bar-B-Que", while my name is TOPS "BBQ". Anyhow, they just put up a site recently, that is vague at the very least and somehow people are ordering from my website for food from them. I have been pointing them in the right direction, but hopefully I won't have to for very long.
I understand that the names sound the same, but we have completely different logos. It was never my intention to take their name or resemble them. My father owns a bar called TOPS Tavern, well I just went off of that. |

This isn't legal advice, but it seems there is a likelihood of confusion...I'd be looking for a new name if they find out they're losing would-be customers. If it were me in that situation, I'd try and turn a $ on the whole deal.
If you're getting folks placing orders they must like your site better than the other or at least be coming across your site first in the search engines.
If you are not attached at the hip to the name and would be willing to use topstavernbbq.com instead or anything else, invite them to make an offer for your Domain name.
As a two word contraction topsbbq.com is worth what ever you can get for it, but realistically it is worth several $$$, email me a phone number and I'll talk further to you about it, (if you're interested).

Good advice there fellas!
The confusion was definitely a problem for me on the site name I had (for a different reason)
I would imagine that since it is just a spelling difference on the "BBQ", you might run into some legal difficulties IF the other company had the DBA first.
How about BIGTOPBBQ?
Whatever you decide to do, I see this as a potential issue down the road if you don't come up with something fair for you both.
Selling the similar name is a great idea, and could be put to them that it's a benefit for you both. They get the extra Domain name, and you get some $$$ for new equipment!
